What is probate?

In Idaho, the probate process is a court-supervised procedure for administering the estate of a deceased person. The process begins with the filing of a petition to open a probate estate with the court. Among other things, the petition must include information about the deceased person, the value and nature of their assets, and the names and addresses of the heirs and beneficiaries.

After the petition is filed, the court will appoint an executor or administrator to manage the estate. The executor or administrator is responsible for collecting and managing the estate assets, paying any debts or taxes, and distributing the remaining assets to the heirs and beneficiaries. The probate process can be a lengthy and complicated process, but it is necessary to ensure that the deceased person’s assets are distributed in accordance with their wishes.
